论侮辱尸体罪的非犯罪化

近年来，非犯罪化已经成为世界各国刑事立法的一大趋势，而我国刑事立法在这一领域仍然进步迟缓。基于法益保护主义与刑法谦抑主义的基本立场，侮辱尸体行为作为一种反社会伦理而无刑法法益保护必要的行为不应认定为犯罪，而应在立法上予以非犯罪化。但是该行为本身作为一种违法行为，仍然应当通过相应的民事法律和治安管理处罚法予以惩戒。
