征地补偿费受偿主体及农地发展权归属探究

理论界对土地征收的目的、范围、以及补偿的标准等研究较多,而对征地补偿费受偿主体及农地发展权归属研究较少,尤其是农地发展权,其主体是农民集体还是土地承包经营权人,理论研究鲜有涉及。该文提出在土地征收中,应将土地承包经营权人作为独立的征地补偿费的受让主体,并且土地发展权归属农民集体。

Research on Acceptance Subject of Land - requisition Compensation and Rights to Agricultural Land Development

There are a host of studies on land-requisition in terms of the cause,range and compensation cri- teria etc,in the academic circle,while contents concerning the acceptance subject of land-requisition compensa- tion and rights to agricultural land development are less involved.Especially rights to agricultural land develop- ment,whether its subject is the farmers' collective organizations or the land contractors and operators has been sel- dom referred.This paper suggests that the land contractors and operators should be regarded as independent accept- ance subject of land-requisition compensation while farmers' collective organizations keep the rights to land development.
