| 摘 要： | 少数民族聚居区,一直存在着民族习惯法与国家制定法并驾齐驱的两套法律体系.要处理好维护法律统一与照顾民族特点之间的关系问题,首先应加强各民族之间的沟通,互相理解隐藏在规则背后的立法本意;其次面对习惯与法律的冲突,司法人员必须坚持这样一个原则对于属于公法调整范围内的案件,国家司法必须介入,并且必须依国家制定法的规定进行审理,不得以照顾民族习惯为由对抗国家制定法.

| Abstract: | In the regions where minority nationalities live in compact communities, there always exists two legal systems: ethnic common law and constitutional law. In order to deal with the relationship of the two systems, we must strengthen communication among all nations. Moreover, to the law cases belonging to public law, we must try it according to constitutional law. Nobody is allowed to resist constitutional law taking considering ethnic customs as reason. |
