CISAC框架下海峡两岸音乐著作权的管理与诉讼

我国大陆地区中国音乐著作权协会（MCSC）和台湾地区的中华音乐著作权协会（MUST）同为国际作者和作曲者协会联合会（CISAC）的成员，两组织在音乐著作权集体管理的合作上有着得天独厚的良好基础。因两岸著作权法存有差异，法律冲突在所难免，唱片公司及词、曲作者选择在外法域单独维权有着成本高、范围小、收效难等缺陷。在CISAC的组织框架下，根据《相互代表合同》，两岸通过著作权集体管理组织的相互代表关系进行合作管理是较经济、务实的选择。

The Management and Litigation of Music Copyrights Cross-Strait under the Framework of CISAC

Both MCSC （Mainland China ）and MUST （Chinese Taiwan ） are the members of CISAC, and their co-operations in collective management of music copyrights has a sound foundation. Because of differences in the laws concerning copyrights between Mainland China and Chinese Taiwan, the conflict of laws is inevitable. There is high cost, low range and low efficiency while the record companies and the creators manage their music copyrights separately by the cross-strait interregional litigation. As the sister societies under CISAC＇s organizational framework, MCSC and MUST can manage their members＇ fights abroad through the Reciprocal Representation, which is more eeo-nomical and practical choice.
