国外行政调解制度考量与反思

行政调解制度在我国由来已久，它在化解社会纠纷、缓和社会矛盾等方面发挥着重要的作用。西方国家对之也高度评价，誉为“东方经验”。在考量大陆法系和英美法系主要国家行政调解制度的基础上，对我国当前行政调解制度的重构进行反思，以期对我国行政调解制度改革有所裨益。

The Considerations and Reflection of Foreign Administrative Mediation System

The administrative mediation has a long history in our country; it plays an important role in resolving social contradictions and disputes in the aspects of society. In western countries, it is regarded highly andreputed as ＂Oriental experience＂. Based on the consideration of continental law and common law countries about administrative mediation system, the author manage to reconstruct the current administrative mediation systern with the hope to reform the administrative mediation system.
