宪法与正义

宪政或法治是现代社会的根本秩序,是发展社会主义民主政治、建设社会主义政治文明和法治国家的重要内容。宪法是宪政不可或缺的必要因素和文本载体,没有宪法就谈不上宪政。但是,从宪法到宪政并不是自然而然的事,一部真正体现民意和时代要求的宪法——正义的宪法是首要的和必需的。"正义的宪法",即宪法的产生和内容上的正义性,或者说宪法的"合法性",这将涉及到宪法的本质。

The Constitution and Justice

The Constitution or governing the country by law is the fundamental order of the modern society,and the main content of developing socialist democratic politics,constructing socialist political civilization and the country ruling by law.The constitution is the necessary factor and Vector Text of constitutional government.However,it is not natural to transform from the Constitution to constitutional government.It is vital and necessary to have a Constitution reflecting public opinion and the requirements of the times or justice.The Constitution with justice,i.e.the justice of its formation and content,or its legitimacy,involves the essence of it.
