摘    要:在劳资矛盾突出的民营、外资企业中,工会没有发挥应有的作用。究其原因,有理论的因素,也有法律上的原因:《工会法》对工会职能的定位亟待厘清;工会组织对于资方的独立性、对抗性体现不够;建立基层工会组织缺乏刚性的法律保障;工会干部维护自身权益没有足够的法律保障;工会经费来源渠道使工会依附于企业主;违反《工会法》没有明确必须承担的违法责任,更重要的是工会维权没有“抓手”,博弈没有“筹码”,因此要在理论上,法律上,制度上大手解决制约工会发挥作用的原因。

Abstract:In the private and foreign-funded enterprises which have obvious contradiction between employers and employees, the unions did not play the role they should do, for which there are theoretical factors and legal reasons: the functions of trade unions regulated by "Labor Union Law" are to be resolved; the independence and opposability of trade unions to the employers are not embodied enough; to establish grassroots unions lack rigid legal protection ; trade union cadres have no enough legal protection to safeguard their rights ant interests; sources of trade union funds make trade unions attached to the business owners; for the violation of the "Labor Union Law," there is no clear law responsibility that must be taken; more importantly, there is no "handle" for trade union to safeguard their rights and strive without "chips." Therefore, the problems restricting trade unions to play a role should be solved though theory, law and institution.
