德法并治与社会本位原则的实现

社会本位作为社会的价值原则,其所产生的巨大凝聚力、调控力,维系着社会的存在和延续。而道德和法律则是实现社会本位原则的途径。本文通过对西方国家德(宗教)法并治及中国古代社会“德主刑辅”以社会本位原则的有限维护和扭曲反映的经验分析,得出了在转型期的中国,只有实行“德法并治”,才能使社会本位原则得到真正的维护,达到国家长治久安的结论。

The rule of law and moral and the realization of the principle of social standard

As a kind of value,social standard which creates massive power of regulation and cohesion,(con-)tributes to the existence and sustenance of the society.Moral and law are the approaches to the realization of social standard.Through empirical analysis on the limited degree of maintenance and distorted reflection of the social standard by rule of law and moral(religion) in western countries and the rule of moral taken priority over law in ancient China,this article draws a conclusion:during the transformation period,in order to reach the goal of the sustainable stability and governance,China should carry out the rule of law and moral to actually maintain social standard principle.
