二元化社会中的法律对公共卫生的消极影响——以艾滋病现象为例

在公共卫生的推进尤其在艾滋病防治中,法律的积极作用是显而易见的,但是其消极影响常为人们所忽视。一方面,法律作为一种桥梁或机制,将社会地位的不平等转化为健康的不平等,使艾滋病成为社会弱势群体的疾病;另一方面法律作为社会因素的一员,它通过社会等级和政治过程的制度形态体现出来,使健康的不平等制度化;在一个二元化社会中,由于艾滋病病人话语权的缺失,这个群体处于十分不利的法律语境之中。

The Adverse Effect of Law on Public Health in a Dual Society:A Case Study of AIDS

When promoting the public health,especially when preventing and curing of AIDS,one can readily feel the positive effects of law while seeing nothing of its negative consequence.On the one hand,serving as a bridge or an institution,law transforms social inequality into health inequality,and makes AIDS an illness of the disadvantaged.On the other hand,being one factor of social determinants,law institutionalizes health inequality through social hierarchy and political process.In a dualistic society,without opportunity to utter their anguish,those who suffer from AIDS are really in a very disadvantaged legal context.
