| 摘 要： | 在我国的雇主责任制度中,雇主责任究竟应采用何种归责原则不仅是一个非常重要的理论问题,而且也是我国理论界仍存争议的问题。从比较法上的考察以及对我国理论界两种代表性主张的评析,可以看出我国雇主责任的归责原则应为严格责任原则。

| Abstract: | In the system of employer's liabilities of our country,the choice among different imputation principles is a very important issue and causes much debate in theory.Through the study on the comparative law and analyze to two typical opinions on the subject,the essay try to conclude that the strict liability should be applied in the imputation of employer's liabilities. |
