| 摘 要： | 中国未确立沉默权有其社会和文化的原因。中国传统思想中权利意识淡薄、民众对政府信任与依赖的传统、对秩序的偏好与自由的疏离的法的价值取向、法学界盛行的工具主义程序理论 ,是其观念原因 ;当前社会治安形势日趋严峻、犯罪率上升、控制犯罪能力落后 ,是其社会原因 ;我国刑诉法现存的强职权诉讼模式 ,是其制度原因。

| Abstract: | The right to silence has been established in every other country and approved internationally except in our country. This paper, beginning with the traditional concepts, discloses the conceptual, social and systematic reasons to explain why the right to silence has not been established in our country, and suggests that we should activtly create a social environment to establish the right to silence in law. |
