| 摘 要： | 刑讯逼供是仍然存在于现代刑事诉讼中的一种屡禁不止的丑恶现象,也是诉讼理论研究上的一大难题。从刑讯逼供的历史入手,对其产生的制度根源和存在条件进行了深入剖析。在此基础上,对现实缺乏制度条件情况下刑讯逼供仍然存在的原因和条件作出了分析,并从诉讼角度对遏制现代刑讯逼供提出了对策。

| Abstract: | Extorting confessions by torture,as a difficult problem in the research of procedure theory,is a phenomenon still existing in modem criminal procedure.With reviewing the history of the phenomenon,this article analyzes the systematic reasons and necessary conditions of the phenomenon.On the basis of the discussion above,this article analyzed the reasons and conditions that the phenomenon still exists where there lacks systematic condition at the same time of providing countermeasures for preventing modern extorting confessions by torture. |
