| 摘 要： | 我国的刑事立案程序存在着严重的弊端,其程序独立性值得质疑。本文通过比较一些国家刑事诉讼启动程序制度设计上的特点,对我国现行刑事立案程序存在的问题进行了全面的分析,认为现行的立案程序既无存在的价值也无存在的必要。它的存在引发了刑事诉讼中许多无法解决的矛盾,应当取消其独立性,并纳入侦查程序之中,代之以相对简化的案件登记制度。

| Abstract: | Serious disadvantages exist in placing a case on file procedure for criminal in our country, the independence of its procedure deserve questioned. The features that compared by some countries'designment on criminal procedure in this article deeply analyses the remaining problems exist in current placing a case on file procedure for criminal, recognize the current main case procedure has neither value nor necessary to exist. Its existence cause too much unresolvable contradiction in criminal procedure. Something should be done to cancel its independence and put it into the procedure of criminal investigation, and make simpler register system take the place of it. |
