| 摘 要： | 知识产权是一种合法垄断,但对其不适当保护也有负面影响,尤其是知识产权权利扩张的异化和国际化趋势,阻碍了经济竞争和社会发展。因此,知识产权应有一定的权利边界,应构建知识产权利益平衡制度,并结合相关的反垄断制度和反不正当竞争制度等一系列政策、法规,促进和谐竞争和经济发展。

| Abstract: | Summary of the essay: Intellectual property rights is a kind of legal monopoly,but to protect it excessively will have negative effect.Especially the alienation of the IPR 's expansion and its globalization trend will hinder economical competition and social development.Based on this the IPR should have fixed boundary,so we should establish the IPR interest balance system combining with a series of policy and laws such as anti-monopoly system and anti-illegal competitions system to prompt harmonious competition and economical development. |
