| 摘 要： | 转化型抢劫罪作为一种特殊形式的抢劫罪 ,由于涉及基本罪和转化罪两个方面 ,在理论上比较复杂。特别是关于转化型抢劫罪犯罪形态 ,理论上存在着多种观点 ,实践中难以认定。认定转化型抢劫罪的犯罪形态必须明确三大理论前提 ,并将转化型抢劫罪划分为基本构成的转化型抢劫罪和加重构成的转化型抢劫罪 ,才能准确认定它的犯罪形态。
