| 摘 要： | 网络时代,利用网络犯罪是随着现代科技发展而反射到刑事法律中不可回避的话题.本文以我国首例网络色情案为例,首次从刑事证据法学角度,对电子证据制作主体身份辨真的定位、存在的难题和困惑、认定的对策等方面予以剖析,以期对我国刑事电子证据制度的完善有所裨益.

| Abstract: | In the cybertimes, cyborcrimes are the inevitable issue with the development of modern science and technology, especially its reflection in criminal law. Taking the first net work pornographic case, the thesis, with an angle of criminal evidence deals with the subject identification, existent difficulties and puzzles, countermeasures, which is hopefully beneficial to the perfection of electronic evidence system in China's criminal proceedings. |
