双“帐户”视角下农村土地承包经营纠纷的个体诉讼决策研究——以集体林地纠纷诉讼为例

引进“经济学帐户”和“心理帐户”决策原则，以集体林地承包经营纠纷诉讼案件为例，分析农村土地承包经营纠纷中个体诉讼者的决策依据，并探索是否可以通过改变决策者决策原则以减少诉讼的发生。结果显示：绝大多数个体诉讼决策者以“经济学帐户”作为决策依据，但也存在根据“心理帐户”原则进行决策的决策者。针对后一类决策，理论上可通过说服个体决策者改变其心理帐户设置，从而改变其“诉讼”决策为“和解”从而降低诉讼发生率，但实践中受到纠纷诉讼对象与现有纠纷调处机制的影响，个体纠纷诉讼决策者与经济组织和其他个体间的纠纷存在和解空间，但难以改变与村委会间的纠纷诉讼决策。

Research on Decision-making in Individual Lawsuits in Rural Land Contract Disputes from the Perspective of Double Accounts: Case Study of Forest Land Lawsuits

The concept and the theory of “economics account” and “mental account” were introduced to reveal principles of decision making in individual lawsuits in rural land contract disputes, and explore the possibility of reducing the litigations by changing principles of decision makers, based on the cases of collective forest land contract disputes. Conclusions are as follows: most of the decision-makers take cost-benefit principle of “economics account”as the basis of decision-making, and no more than 10% decision-makers take cost-benefit principle of “psychological account”as decision-making basis. Regarding the latter, it is theoretically possible to change its “litigation” decision to “compromise” by persuading individual decision makers to change their mental account setting. However, in practice, affected by the objects of the dispute lawsuit and the existing dispute mediation mechanism, it is possible to mitigate the dispute between the economic organization and other individuals, but it is difficult to change the decisions in disputes between individual decision makers and village committees.
