| 摘 要： | 通过商业秘密刑法保护对象,商业秘密确认程序,商业秘密诉讼程序,诉讼程序中的举证责任对各方面的论述,明确了商业秘密刑法的保护范围,行政上的确认程序,刑事诉讼人的诉讼程序及在诉讼过程序中举证责任的分配,从而使商业秘密在刑法保护方面有了更明确的诉讼程序,完善了商业秘密刑法保护的体系。

| Abstract: | Through expounding the objects of protection by criminal law concerning commercial secrets,the determination procedure for commercial secrets,the legal proceedings for commercial secrets,as well asthe evidence presenting responsibility in legal proceedings,this paper makes clear the scope of protection bycriminal law with regard to commercial secrets,the administrative procedure of determination,the legal pro-ceedings for prosecutors as well as the sharing of the responsibilities for evidence presenting in legal process,so that commercial secrets have more explicit legal proceedings in respect of criminal law protection and haveperfect protection system. |
