| 摘 要： | 司法实践中,对于接受或放弃遗赠表示的相对方有不同的理解和适用。在分析现有法律规定之不足的基础上,借鉴国内外理论,对接受或放弃遗赠中相对方的确定、意思表示的生效和形式要件等问题给出立法建议。
