| 摘 要： | 我国刑法理论中关于举动犯存在诸多不同的观点,其最根本的分歧在于能否以着手作为认定举动犯的既遂形态的标准。着手不能作为判断举动犯是否既遂的标准。举动犯没有独立存在的必要,举动犯就是行为犯。

| Abstract: | The theoretic type of behovioral offense cannot lay basis on the theoretic standard of beginning. Due to our analysis of criminal behaviour, we take it true that the theoretic type of behovioral offense has nothing useful in guiding justice practice and no reason to exist in criminal law theory. |
