| 摘 要： | 《反垄断法》在第一条中明确规定了该法的目标，但是如何解读该条规定，以及该条在司法实践中如何发挥指导功能，学界仍然存在分歧。争论的焦点在于：反垄断法的目标究竞是“竞争机制”还是其他“利益”或“价值”以及如何协调它们之间的过渡关系等。在反垄断法即将生效的今天，对其目标的理解已经成为理论和实务界无法回避的问题。
