| 摘 要： | 心理现象在当代刑法的结构与运作中无疑扮演着举足轻重的角色，对于成立犯罪并进而衡量犯罪、裁量刑罚发挥着不可或缺的功能性作用。由于世界各国立法对此规定的抽象性，因此围绕心理现象之刑法机能检讨问题，学术界存在激烈的争论。此争论有助于刑法理论的明晰，进而有助于我国刑事法律制度的完善。
