| 摘 要： | 《中华人民共和国刑法修正案(六)》第十七条新增的规定突出了刑法对残疾人、儿童的人身权利的保护,但其罪名尚未正式确定。该罪所保护的客体类型不同于一般组织型犯罪,在司法适用中,应注意该罪与相关犯罪的区别和界定。

| Abstract: | The seventeenth item of the PRC Criminal Law Amendment(6) has added a new crime,which gives prominence to the protection of the personal rights of the disabled and the children of the criminal law,and the name of this new crime has not been confirmed.The right which is protected by this crime is different from those protected by the systematical crimes,and this difference brings many questions to us.Distinguishing this crime from interrelated crimes is very important in judicial confirmation. |
