| 摘 要： | 对行政裁决诉讼进行调解有法律和法理上的依据。在具体程序上,应界定可调解的行政不当的确切范围,提出第三人不参加调解时的对应策略,依“先行后民”的原则作出调解书。该制度有深刻的现实意义。
