| 摘 要： | 两高《办理受贿适用意见》所作解释的内容不是仅限于受贿罪的适用范围,而是扩展到了受贿罪之外的其他贿赂型罪名,这是由于受贿罪与单位受贿罪、非国家工作人员受贿罪、利用影响力受贿罪的相同性,受贿罪与行贿罪、对单位行贿罪、对非国家工作人员行贿罪、对外国公职人员和国际公共组织官员行贿罪的对合性,以及受贿罪与介绍贿赂罪的关联性,从而就决定了两高《办理受贿适用意见》应当适用于包括受贿罪在内的所有贿赂型罪名。

| Abstract: | The interpretation over ＂Applicable Opinions for Briberies＂ by the Supreme People＇s Court and Supreme People＇s Procuratorate is not limited to the scope of bribery,but extends to the bribery charges other than the type of taking bribes.This is because of the similarity between taking bribes national staff and that by units,by non-state staff and by using influences,the contrast between taking bribes and giving bribes,giving bribes to units,to non-state staff,to foreign officials and to international institute officers,and the relevance between taking bribes and introducing bribe crimes. |
