| 摘 要： | 原因自由行为之所以具有可罚性，在于其是一种具有社会危害性且明显侵害法益的行为，但这却与刑法理论中“责任能力与实行行为同在”这一基本责任原则相冲突。基于原因自由行为的特殊性，将其可罚性看做是刑法基本责任原则的例外更为合理。
