| 摘 要： | 原因自由行为包括自陷限制责任能力状态而实施犯罪的情况 ,具有可罚性 ,其处罚对象是原因行为与结果行为的合并。原因自由行为的主体没有任何限制 ,主观方面可以是故意也可以是过失 ,确定原因自由行为主观罪过的时间应视具体情况而定

| Abstract: | Leading himself to be a person of limited criminal responsibility and to commit a crime belongs to Action Liberal Cousa. Action Liberal Cousa should be punished. The causal act and consequence act are the punished as the object of Action Liberal Cousa. The subject of Action Liberal Cousa shouldn't be limited. Its aspect includes intent and negligence. The time to ensure the subject offence of Action Liberal Cousa should rely on the concrete situation. |
