对刑罚报应论的再思考

刑罚的报应论在与预防目的论的竞争中逐渐处于下风,即便在刑罚一体论的框架中也处于次要地位。之所以如此,是因为人们认为报应等同报复,该理论内部无法统一,其假设前提存在缺陷。这是对报应论的误解。报应论作为刑罚本质理论,在刑罚体系中应该占有一席之地。

Rethinking about Retribution Theory

Retribution theory has gone to fall comparing with the precautious theory just in the framework of united theory.That people think retribution theory is equal to retaliation,not united and has not enough hepothesis leads to the result.This review is a misunderstanding,and rertibution theory should have its place in the field of criminal theory.
