| 摘 要： | 世界各国有关紧急避险中法益权衡的刑事立法有不同规定,刑法理论上对紧急避险的本质也有不同认识。在紧急避险侵害相等法益时,只有承认其合法性才有利于刑法保护法益目的的实现。

The author stands on the position of the theory of infringement of legal interest, approving that the essence of the urgent act of rescue is illegal prevention monism. |
