| 摘 要： | 职务犯罪中不同身份者共同犯罪普遍存在。而刑法对此没有作出具体规定，司法解释也不尽合理。刑法学界存在的不同学说也带来了司法实践中的混乱。基于对共同犯罪本质的理解，结合部分犯罪共同说和想象竞合犯理论，这种情况宜解释为共同犯罪的想象竞合犯，根据“从一重罪处”原则定贪污罪。
