| 摘 要： | 不作为犯罪成立的前提是行为人具有作为义务。先行行为是各学说都认可的义务来源之一。但理论界对先行行为的范围存在争论,犯罪行为是否属于先行行为便是争论之一。根据刑法的通说理论及立法宗旨,犯罪行为不应属于不作为犯罪中的先行行为。

| Abstract: | The crime of omissions is an important topic in the criminal law theory.Takeing the duty as the crime establishment premise is also the key of crime of omissions,in which advance behavior is the voluntary origin.But the advance behavior scope also has the argument.Whether criminality belongs to the advance behavior then is one of the arguments.The author thinks that the criminality should not belong to the advance behavior. |
