我国刑事审前法官制度的建构

顺应各国司法改革加强司法控制的潮流，我国应当设立刑事审前法官，使其介入刑事审前程序。刑事审前法官应当与审判法官严格分离，单独建制，并应严格控制其资质条件；刑事审前法官行使侦查控制、公诉审查等多项权力；侦查控制应当强制启动；应设立羁押听证程序等等。

The Construetion of Criminal Pre-trial Judges System in China

In response to the trend of national judicial reform to strengthen judicial control, Chinese criminal trial should be set up Pre-trial judge system, to intervene pre-trial criminal procedure. Criminal pre-trial judges should be a separate system, with strict separation of trial judges to strictly control the conditions of their qualifications; criminal investigation of pre-trial judges to exercise control over the powers of indictment review; control should be mandatory to start the investigation; the establishment of procedures for detention hearings and so on.
