| 摘 要： | 作为证据之一的鉴定结论对于诉讼中涉及到专门性问题的认定至关重要,而鉴定人制度又是其核心内容。本文首先介绍了美国专家证人的资格、委任和出庭作证;接着就其合理内涵与制度缺陷及其补救措施进行了详细的分析;最后,在结合我国的现状与借鉴美国的有益作法的基础上,提出了建议。

| Abstract: | Expert testimony as one form of evidence plays an essential part in the identification of specialized issues in the proceeding.The core of which is closely concerned with expert system.The article firstly presents qualitications, appointments and appearance in court of experts in America and then sets forth a edee analysis or their inner meanings and defects by which some valuable measures are provided.Finally, combined with American practice and our country's present situations, some reasonable suggestions are ot fered. |
