| 摘 要： | 大陆法系的刑法理论博大精深,特别是以贝卡里亚和费尔巴哈为代表的大陆法系刑法学家的观点开创了大陆法系近代刑法的新思路。罪刑相适应、罪刑法定、刑罚人道主义等这些先进的刑法理论就是近代大陆法系刑法理论的代表,其不仅推动近代刑法的发展,甚至对当代刑法的制定都有很大的指导作用。资产阶级革命胜利后,以法国和德国为代表的大陆法系国家在刑法理论指导下开始了近代刑法典的制定。这些大陆法系国家刑法典的制定,奠定了近现代刑法典的模型,也推动了当今世界刑法的发展。

| Abstract: | The author was talking about criminal theory of the civil law system in modern times,including Beccaria's criminal thinking and Feuerbach's criminal thinking,and setting forth the criminal practice of the mainly countries of the civil law system,including Germany,Italy and so on.At last,the author was pointing out the influence of civil law system's criminal law,including Japan,Latin America and China in modern times. |
