| 摘 要： | 期待可能性理论的条件包括事实要件和价值要件.前者由客观要素和心理要素构成;行为客观情状的非常性,行为动机形成的受涉性.后者是指行为在刑法上的可宽宥性.必须同时具备事实要件和价值要件,才能成立期待可能性的弱失.本文由一个案例出发,结合期待可能性适用要件,对案件行为性质的认定进行探讨.
