新专利法在加强专利权保护方面的完善

专利权的保护是各国专利法的核心问题.强化对专利权的保护,这也是中国专利制度发展的关键.此次修改专利法,主要明确了专利侵权损失赔偿额的界定、诉前临时措施、发明专利临时保护纠纷案件诉讼时效、方法专利侵权诉讼中的举证责任、专利行政诉讼第三人主体资格,以及管理专利工作的部门的地位与职能、管理专利工作的部门的行政执法地位等问题.

Newly-amended Patent Law Further Improves Patent Protection

This amendment of patent law mainly defines how to determine the damages of patent violation, preliminary measure before suit, suit limitation and approach of dispute on preliminary protection of invention patent, burden of proof in patent litigation, the subject qualification of the third party in patent administrative litigation, the status and function of the patent management department and the administrative enforcement status of the patent management department.
