| 摘 要： | ＂重定罪、轻量刑＂,＂法官自由裁量权过大＂等现象是我国司法实践中较突出的问题,直接影响到量刑的公正性。构建独立的量刑程序,成为解决这一问题的主流观点。以程序为视角,可以探讨出独立量刑程序的内在价值。

| Abstract: | The phenomenon,such as focusing on fixing crime and neglecting penalty measurement,judge＇s decision rights is lack of limitation,are the outstanding problems in judicial practice field.It impacts the fair of penalty measurement directly.The main view to resolve this problem is to build up independent penalty measurement procedure. the inner value of this procedure can be made out form procedure angle. |
