| 摘 要： | 行为人由于过错导致承载他人创作成果的唯一载体灭失，如果他人的创作成果是著作权法所保护的作品，则行为人的行为不但侵害了他人对该物质载体的财产所有权，还侵害了他人对该载体上所承载的作品所应享有的著作权，应按导致作品唯一载体灭失的各方的过错大小来认定损害赔偿责任。

| Abstract: | The excusive works carrier which is also protected by Copyright Law was destroyed by fault, the person will not only tore the property right of the carrier, but also violate the copyright of the works. So the damage compensation liability should be identified by the respective fault. |
