| 摘 要： | 构成检察制度基本内容的侦查权是古今中外法律制度的一个基本权力,通过对检察侦查权的历史渊源进行考察,可以更好地理解检察侦查权形成的深层原因。检察侦查权的中外历史渊源可以从三个方面加以探寻,分别是传统中国监察机关与御史调查权、近代西方检察制度与检察侦查权、苏维埃检察制度与检察侦查权。

| Abstract: | The investigation power,which constitutes the basic content of the procuratorial system,is a basic right in ancient and modern Chinese and foreign legal systems. By examing the historical origins of the investigation power,it is possible to better understand the underlying causes of the investigation power of procuratorial system. The historical origins of investigation power of procuratorial system in China and abroad can be explored from three aspects. There are the traditional Chinese procuratorial organs and royal history investigation power,modern western procuratorial system and procuratorial investigation power,Soriet procuratorial system and procuratorial investigation power. |
