论证据的可采性

在英美法系中，证据的可采性与证据的重要性、关联性等一起构成证据的属性或要素。只有具有可采性的证据，才能被法律容许用于证明案件的待证事实，因此，证据的可采性关系到证据的接受予否，是一个至关重要又十分复杂的问题。我国的证据法学的改革应当在总体上借鉴大陆法系证据制度的前提下，以英美法系证据采用规则和证据排除规则中的某些内容作为必要的补充。

On the Admissibility of an Evidence

In the Anglo-American law system,the admissibility,the importance,the relevance of evidence constitute the elements of evidence. Only the evidence with admissibility can be used to prove the facts to be proved of a case,so the admissibility of evidence decides whether the evidence to be accepted or not. The evidence act of China should use the evidence institution of the continental law system for reference and adopt some content of the accepting rule and exclusive rule of evidence of the Anglo-American law system as necessary supplement.
