| 摘 要： | 道家的“法自然”的文化意蕴与“自然法”思想有着本质区别。第一，“无讼”与“尚法”：两种不同的法律态度。“法自然”认为社会和谐就是一切顺其自然，没有冲突，没有法律，而西方“自然法”观念十分尊崇法律的权威与保障功能。第二，“天人分立与天人合一”：两种不同的思维方法。第三，理性与和谐：两种不同文化要义。理性是西方“自然法”思想的精神内核，而“法自然”是要自然无为恢复宇宙原始和谐状态。

| Abstract: | The cultural meaning of Taoism's "Emulating Nature" distinguishes the thought of "Natural Law" from its essence distinctly. Firstly, "non-law" and "full-law" are the two different attitude of law. According to "Emulating Nature" social harmony is to follow the natural rule, without conflict and law, however, western "Nature Law" advocates the authority and the protective function of the law. Secondarily, they advocate two different thought: the combination of human and environment, the separation of the both facts. Thirdly, sense is the spiritual core for western "Natural Law", while harmonious situation is the cosmic originality that "Emulating Nature" requires. |
