| 摘 要： | 治安管理与道路交通安全管理同属国家警察行政管理,都是全国人大常委会制定的普通法律,地位是同等的。二者的区别在于:一是治安管理不同于道路交通安全管理;二是《治安管理处罚法》加强了与《道路交通安全法》等法律之间的协调性;三是行政处罚的追究期限不同。执法实践中应正确、灵活地运用《治安管理处罚法》和《道路交通安全法》,使执法活动更加严格、公正、规范。
