论我国司法改革中的警检关系

我国公安机关的侦查与检察机关的审查起诉,是刑事诉讼中前后衔接的两道工序,它们的关系模式直接影响诉讼效率和质量。现行警检关系存在着一定的弊端,导致诉讼秩序混乱、诉讼效率低,应借鉴大陆法系国家模式,确立警检职能一体化关系,减少控诉职能主体的内部摩擦,从而提高诉讼效率。

Our country's investigation of the public security organs and the checkup of the prosecuting organ are the two consecutive working procedures, whose relationship mode directly affects the prosecution efficiency and quality. There are certain malpractices in the current police and the prosecuting organ's relationship, which cause the prosecuting disorder, low-efficiency. We should use the continental law-system countries mode for reference, establish the integrative relationship between the police and the prosecuting organs and reduce the friction in the prosecuting function main body so as to improve the prosecution efficiency.
