改革我国行政复议体制的法律思考

行政复议法实施以来,对规范行政行为,保护公民、法人和其他组织的合法权益起到了很大作用。但行政复议体制不合理,责权不对称,行政复议机构及其人员缺乏独立性,不能保证公正裁决,妨碍行政复议工作正常开展。对现行行政复议体制一般性修补,实为下策。重构我国行政复议体制是大势所趋,建议取消上级部门和垂直领导机关作为行政复议机关,规定县以上人民政府所在地只设一个独立的行政复议机关,赋予其独立办案的职权,确保复议结果公正。继续确立合法性、合理性审查原则,并加强对行政复议机关及其工作人员的监督。目前,由政府法制办公室作为行政复议机关比较妥当。

The implementation of Administrative Reconsideration Law has played a significant role in standardizing the administration activities, protecting the legal rights of the citizens,legal persons and other organizations.However,its disadvantages which include unreasonable administration reconsideration system,dissymmetry of responsibility and rights also prevent the administration reconsideration from further development.Besides,the related organizations and staff are lack of independence.All these result in the difficulties to guarantee the fair verdict.Instead of the normal modifications of the present system,it is necessary to re-establish Administrative Reconsideration Law of China.It is advised that the upper or direct authorities shall not be the administrative reconsideration organization.Only one dependent administrative reconsideration organization will be established at the local governments whose level is above the county level.This organization will be authorized to play its role independently to ensure the fairness of the reconsideration results.Besides,the principals of legal and reasonable investigations are proposed and the supervisions on the administration reconsideration organization and its staff should be enhanced.Presently,it is more appropriate to make the government legal office to be the administrative reconsideration organization.
