| 摘 要： | 在现有再审制度下,案外第三人在因生效判决错误而遭受不利时,很难对自己的合法权利进行救济。第三人撤销之诉就是程序法上为保护案外第三人利益而进行的程序安排,我国民事诉讼法立法确认这一制度有其必要性和正当性。

| Abstract: | It is difficult for the third party to protect his benefits when he is hurt by a false judgement in current retrial procedure.As for the third party beyond a suit,to allow the third party to challenge the judgement by providing a retrial suit is a good arrangement.It will be necessary and reasonable in the civil procedural law. |
