中外危机善后中的行政补偿之比较

公共危机善后处理是危机管理的一个重要环节。危机善后处理的内容不仅包括因政府应急管理中的过错、违法行为造成的损失进行的行政赔偿，也包括因政府应急管理中的合法或无过错行为导致的损失进行的行政补偿。通过与法制完备国家对危机致损的行政赔偿范围和程序的比较可知，我国行政赔偿的法律制度基本确立，但法律位阶不够高，范围不够广，补偿规范表述较为笼统，行政补偿程序中紧急补偿程序和司法程序尚待完善。

Comparison between Administrative Compensation Conducted by China and Foreign Countries While Handling Crisis

Handling public crisis is an important link in crisis management. The content of handling crisis includes not only the administrative compensations for the loss caused by the mistakes and illegal actions conducted by the government when handling urgent situations, but also those caused by legal and correct actions. Through the comparison with the scale and procedure of administrative compensation for the loss caused by crisis, which is conducted by foreign countries with perfect legal system, we can learn that though we have roughly established the legal system for administrative compensation, the legal position is not high enough, and the scale is not wide enough, either, and statement of compensation scale is somewhat general. Further more, the urgent compensation procedure and judicial procedure should be perfected.
