风险社会下职务犯罪办案风险防控机制的构建

检察机关在查办职务犯罪案件过程中，由于职务犯罪主体的特殊性，使得职务犯罪办案风险与普通刑事犯罪相比有明显不同。特别是当前职务犯罪呈现出智能化、隐蔽性等发展趋势，传统办案风险防控机制已不能适应侦查工作发展的需要。职务犯罪侦查部门应建立办案风险防控的长效机制，完善风险防控的应激机制，并根据办案阶段和风险类型的不同，可呆取多种形式化解办案风险。

On Construction of Prevention and Control Mechanism for the Risk of Handling Power Abusing Crimes in Risk Society

In the process of handling power abusing crimes, the particularity of power abusing crimes gives rise to evident difference between the risk of handling power abusing crimes and that of handling general criminal crimes. Presently, the power abusing crimes tend to be intelligent and elusive, which makes traditional prevention and control mechanism for the risk of handling crimes inconsistent with criminal investigations. Therefore, the investigation organs for handling power abusing crimes should develop a long-term prevention and control mechanism for the risk of handling crimes, improve stress-response mechanisms for risk prevention and control and take diversified forms to resolve the risk of handling crimes in accordance with the different phases and risk categories of handling crimes.
