“吃空饷”的刑法思考

一些国家财政供养人员利用在编不在岗、留职不停薪、死亡不注销、调出不下编、虚报工资表、受刑仍领薪等手段"吃空饷"的现象屡见不鲜,屡禁不绝,甚至有蔓延的趋势。"吃空饷"的行为危害很大,影响也极坏,属于新型的贪腐形式,除了加强制度建设,强化监督管理之外,建议对"吃空饷"的行为运用刑罚手段进行惩治,依法追究有关责任人的刑事责任。

"Paid post absence" is not unusual and tends to be prevailing in China."Paid post absence" represents the new-type corruption,which creates significantly deleterious impact on the society.Therefore,in addition to strengthening of supervision and system construction,criminal punishment laws should be used against "paid post absence".The personnel in charge shall be investigated for criminal responsibilities according to law.
