| 摘 要： | 制度是一种规则或规范的安排,一种人类的理性选择;任何制度都包含着伦理意蕴;政府作为制度设计的主体,由于其公共人的角色与地位,其价值诉求也包含着维护社会公正、公平与正义;政府在制度设计时应充分考虑制度的伦理精神,体现制度的伦理关怀。

| Abstract: | Institution is a kind of arrangement of rules or norms. It represents a kind of rational selection of the human being. Any institution contains ethic meaning. Being the main designer, government pursues the values such as justice and equality due to its "pubic man "position. So government should consider fully the ethics of institution and embody it when design institutions. |
