犯罪既遂标准的重构

犯罪既遂标准存在构成要件说、结果说、目的说三种理论。目前作为通说的构成要件说是不科学的。结果说与目的说各有其合理之处,在融合二者合理成分的基础上,提出判断犯罪既遂与否的科学标准,即行为人主观上追求的、行为性质所决定的逻辑结果的发生这一特定目的是否实现。

The reconstruction of the Standard of Accomplished Crime

There are three theories about the standard of accomplished crime: the theory of criminal purpose, the theory of criminal consequence and the theory of criminal constitution. The last one is prevailing but not the best one and the other two are also rational. Combining the advantages of these two theories, we may set a scientific standard to judge if a crime is accomplished or not. Whether the actor's purpose and the logical consequence of the act has been accomplished or not should be the standard.
